WILL OF NICHOLAS M. GILMER

In the name of God, amen.  I, Nicholas M Gilmer of Christian County & State of Kentucky, do make and ordain this my last will & testament, hereby revoking all wills by me previously made.

Item 1st, It is my will and I do hereby direct all my just debts be paid.

Item 2nd, I have heretofore given my sons, John Gilmer, Meriwether L. Gilmer, Micajah W. Gilmer, Francis M. Gilmer, Nicholas M. Gilmer and my daughter Sarah S. Browder eight hundred & eighty dollars each & my daughter Mildred M. Parrish one thousand dollars, it is my will and I do hereby direct that when they come to claim their part of my estate they be charged with that sum each.

Item 3rd.  It is my will and I do hereby direct that my son John Gilmer receive my estate as it stands at my death at valuation.

Item 4th.  It is my will and I do hereby set apart seven thousand dollars each for my daughters Amy P. and Mary P. Gilmer, making fourteen thousand dollars which is to be paid over to John Gilmer as guardian for said daughters from which they are to receive annually the lawful interest for their support.  It is my will & I do hereby direct in the case of the death of one or both of them the principal is to be equally divided amongst all my grand children.

Item 5th.  It is my will and I do hereby direct that the remainder of the proceeds arising from the sale of my estate be equal divided amongst the balance of my children, to wit, John Gilmer, Meriwether L. Gilmer, Francis M. Gilmer, Sarah S, Browder, Meriwether L. Gilmer as guardian for Nicholas M. Gilmer, Francis M. Gilmer as guardian for Sarah JW [?] Gilmer, daughter of Micajah W. Gilmer, deceased, David W. Parrish as guardian for Amelia C. Parrish & W. H. Parrish, children of Mildred M. Parrish, deceased.

Item 6th.  If is my will and I do hereby direct that my son John Gilmer be allowed four years in which to pay for my estate without interest.

Item 7th.  It is my will and I do hereby direct that there be a lien retained upon the land to secure the principle & interest of Amy P and Mary P, Gilmer as mentioned in the 4th item. It is my will and I do hereby direct that if my son John Gilmer should wish to sell the land he can do so by giving good security for said fourteen thousand dollars.

Item 8th. I do hereby nominate and appoint my sons in law Robert Browder & David W. Parrish & my sons Meriwether L. Gilmer & John Gilmer executors to this my last will.  In testimony whereof I have hereunto set my and & seal this 29th day of November 1858.
